Apple triumphs over Samsung in landmark patent case

Apple Inc (Nasdaq: AAPL) scored a sweeping legal victory over Samsung Electronics (Seoul: 005930) on Friday as a U.S. jury found the Korean company had copied critical features of the hugely popular iPhone and iPad and awarded the U.S. company $1.05 billion in damages.

The verdict -- which came after less than three days of jury deliberations -- could lead to an outright ban on sales of key Samsung products and will likely solidify Apple's dominance of the exploding mobile computing market.

Apple's victory is a big blow to Google, (Nasdaq: GOOG) whose Android software powers the Samsung products that were found to infringe on Apple patents. Google and its hardware partners, including the company's own Motorola unit, could now face further legal hurdles in their effort to compete with the Apple juggernaut.

Samsung lawyers were grimfaced in the quiet but crowded San Jose courtroom as the verdict was read, and the company later put out a statement calling the outcome "a loss for the American consumer."

The jury deliberated for less than three days before delivering the verdict on seven Apple patent claims and five Samsung patent claims -- suggesting that the nine-person panel had little difficulty in concluding that Samsung had copied the iPhone and the iPad.

Because the panel found "willful" infringement, Apple could seek triple damages.

Apple upended the mobile phone business when it introduced the iPhone in 2007, and shook the industry again in 2010 when it rolled out the iPad.

It has been able to charge premium prices for the iPhone -- with profit margins of as much as 58 percent per phone -- for a product consumers regarded as a huge advance in design and usability.

The company's late founder, Steve Jobs, vowed to "go to thermonuclear war" when Google launched Android, according to his biographer, and the company has filed lawsuits around the world in an effort to block what it considers brazen copying of its inventions.

The legal win on Friday came one year after CEO Tim Cook assumed the helm of the company. Shares in Apple, which just this week became the biggest company by market value in history, climbed almost 2 percent to a record high of $675 in after-hours trade.

Brian Love, a Santa Clara law school professor, described the verdict as a crushing victory for Apple: "This is the best-case scenario Apple could have hoped for."

CHALLENGE FOR COMPETITORS

The verdict comes as competition in the mobile device industry intensifies, with Google jumping into hardware for the first time with its Nexus 7 tablet, and Microsoft'(Nasdaq: MSFT)'s new touchscreen friendly Windows 8 coming in October, led by its "Surface" tablet.

Apple's victory could present immediate issues for companies that sell Android-based smartphones and tablets, including Google's own Motorola subsidiary, which it acquired last year for $12.5 billion, and HTC of Taiwan.

Is it possible to rekindle a relationship if they don't love you anymore ...

I warn you, this is a long one. I'd really appreciate it if you read it and could help me because I'm very desperate at the moment. I'm in agony.

Yesterday, my boyfriend broke up with me for good this time. He breaks up with me a lot, at least every week but this time it was different because he said that he doesn't love me anymore.

BACKGROUND:
We had been going out for a year and have been arguing a lot throughout the whole duration. The main issue is trust, on my part. I have never been and never will be "good enough" for my parents. They never congratulate me for my achievements, instead they tell me how I could've done better. In past relationships, my paranoia has confirmed the need to be paranoid because in my past relationships, my partner was unfaithful. Also my lack of empathy in this issue plays a part. My ex's past was tainted which always had me wondering if he was cheating on me because that was the sort of person he was, yet I failed to realise that my past was just as bad, maybe even worse so it wasn't fair I was treating him like a criminal. And I never considered that maybe he was different now he met me and had fallen in love for the first time. I am the barer of poisonous thoughts, mainly through my paranoia. They eat away at me. Block me from trusting partners.

HOW IT ALL BEGAN:
His friends are not the best influence, they are immature and sleep around. None of them had girlfriends, morals, boundaries or responsibilities. So I tried my best to stop him seeing them because I didn't think they were good for us. He stopped seeing them much. We'd spend every day together, because I love being with him but also so I could keep an eye on him. He'd comply by seeing me every day and little things like calling me in his lunch break and coming to mine as soon as he had his tea at home. I didn't like him having Facebook so he removed it. I didn't like how he added so many girls on Twitter so he stopped doing it. He smoked but stopped for me. These are just a few things he did for me.

THE REALISATION:
The first 8 months were the best, we still really fancied each other, we had a great sex life and we just basically adored each other. We had a lot of arguments and I would always threaten to leave him to which he'd be begging me to stay, every single time. I took him for granted SO SO much and this is my biggest regret, not just in this relationship but my life so far. Because I took him for granted, I was abusing his loyalty. It began to take its toll and he bit back. I'd realised where I'd gone wrong and tried to fix it but at that point, he'd had enough. He stopped trying. We stayed in the relationship for 4 more months but under great difficulty because now he wasn't bothered anymore, he'd stopped trying and he was the one breaking up with me, several times a week in fact. In a typical argument, we both had parts to play. I'd get annoyed at pathetic things (due to paranoia) and he'd go crazy at me because he had no patience anymore. Every little problem was an argument and almost every argument, he'd want to break up with me and a lot of those times, he did. We argued more or less every day. I want to say I tried my hardest but I only probably tried my hardest in terms with what I was comfortable with. I wasn't comfortable with him seeing his mates a lot or having Facebook so I didn't try that much in that respect and that's where I went wrong. I made no sacrifices or compromises only adjustments. He'd made so many sacrifices for me and I was really unwilling to which is why we are not together now. Now I realise this, with the help from his mum who's been texting me. But I think it's too late. He'd fed up.

HIS FLAWS:
He makes mistakes too, it's not all me. A lot of them stop me trusting him. Like when I ask him to stop breaking up with me whenever he's angry. He still does it because in the moment, that's how he feels. But that doesn't help the trust thing. He's also very angry and short tempered. He always assumes when someone is talking to him about something he's done wrong, they're having a go at him. He never stops to realise maybe they're helping him by just talking about it, not having a go. Also, his own insight into his feelings are poor. When he's in a good mood, he says he's happy but when he's in a bad moon, he'll say he's unhappy. He never tells me how he generally feels about the relationship, because he doesn't actually know. Sometimes he wants to break up and other times he's begging me to stay. He is never really sure how he feels in general, it's all based on the mood at the time. He says the nastiest things when we're arguing and breaking up but then tells me he only said it because he was frustrated. So I never know what to believe.

This applies to the current situation, the past few weeks have been really difficult. Last week, he told me I was his everything. Yesterday, he told me he doesn't love me. Because the past week has been so hard in particular, I have a feeling that this mood has overridden his opinion and has made him think he doesn't love me. When I asked about last week and how he said I was everything to him, he said he must have been mistaken. Now I don't know whether he's saying that because he's being overridden with this low mood or whether he genuinely feels like that seeing as though he's been feeling off for the past 3 weeks but it's something to keep in mind.

PLAN:
I'm desperate to be with the person I love, and I'm hoping he does actually still love me. When I spoke to his mum, he said things that really opened my eyes. I really want to sit down with them both and have her tell us what she thinks we need to do. When two people are in love, they get tunnel vision. All the things she said, I'd never even thought of before and it was really inspiring. I think that if she sat down with us both, we can work out a clear goal to being happy. The trouble is getting him to agree to see me, right now he doesn't want to speak to me, is ignoring my texts and was really reluctant to talk to me when we were breaking up because he had "nothing to say" and didn't want to listen to me. I asked his mum yesterday if we could all talk today but she said she'd have to ask him and I know he'll say no. She's also not replied today. I might ask again tomorrow or Friday and if he declines, I might just speak to his mum because I could really do with her insight. She did say she thought it would "all blow over" but I think she's just saying that because we've broken up that many times and gotten back together. However, I'm worried that in this time, he'll be occupying himself with activities that will convince him he's happy without me. So I'm in two minds whether to act now before he realises he's better off without me or later when he may have cooled off, maybe even realised he still loves me. What should I do?

All I want is a second chance now that I know the stuff his mum's told me but I'm also certain that that's the last thing he wants right now.

Also, does anyone have any words of support for this break up? I lost my best friends last year so I don't have many people to talk to or be with (which is also why I spent all my time with my boyfriend) and my family aren't supportive. I know I should keep myself busy but I find it hard to motivate myself.

Art Kissinger and Dan Cornwell had been living in San Antonio but looking for a lakefront property in Central Texas when they found this quiet spot on the Sandy Creek Arm of Lake Travis in Volente. Both with real estate backgrounds, they went through 10 sets of plans to design a perfect home for entertaining.

While they bought the property in 1998, construction finished in 2005 after 18 months of building.

One important thing to Kissinger and Cornwell: They did not want it to look like a typical Texas Tuscan home. Instead of limestone, they chose a stone with reddish brown hues from a quarry in Arkansas. They say the style of the house is more country French.

While they have loved living on Lake Travis and the vibe of Volente, they have decided to venture into multiple living sites: a place downtown, starting a bed-and-breakfast in East Texas and a mountain home in Colorado. They have put 8416 Lime Creek Road on the market for $3,325,000 with Michael and Stacy Spickes of Realty Austin.

During the construction, a rumor began to circulate that it was being built for George Clooney, Kissinger says. He heard it from a man passing by while the home was being finished. Later, he heard it from real estate agents in the area. Kissinger jokes that if George Clooney wanted to buy it, they could make it officially the Clooney House.

The gated property opens up with a porte-coch?re under a large circular drive.

Through stone archways, find the front door set back from the driveway.

Travertine floors flow from the foyer to the large dining room, with built-in buffet with glass-fronted cabinets and a large window. Further ahead, the rotunda with a mosaic inset reveals the circular staircase upstairs. The rotunda?s dome is finished in metallic paints, the same as the foyer ceiling, which changes color as light hits it differently throughout the day.

The living room features a 50-inch stone fireplace, walnut floors and a large, arched window overlooking the lake.

To one side of the living room is the office with built-in alder cabinets and the master suite.

The master bedroom provides a bay window and fireplace surrounded by the same stone as the exterior. A doorway between the bedroom and bathroom leads to a private porch and the backyard.

The master bath offers two separated vanity areas with Juparana Persa granite, marble and travertine. The walk-in shower features multiple showerheads, as well as a separated steam shower. A jetted tub sits before it. In one unique feature, the toilet area offers its own small sink. The suite offers a large closet with many built-ins.

The other side of the main floor provides the large kitchen with Juparana Persa granite island and counters, alder cabinetry and stainless steel appliances. The pantry provides plenty of space for small appliance storage, and the kitchen also offers a coffee or wine bar.

From the kitchen, the family room unfolds with a glass door that completely folds into the wall, creating a seamless transition to the balcony.

Beside the family room is the octagonal enclosed sunroom, a full breakfast room and a pool bathroom that is done in peacock color scheme with a stained-glass peacock window.

The pool area is immaculately designed with a spa, a bridge over the pool, a beach area, swim-up seating and a water slide, all surrounded by stone and tropical landscaping.

Underneath the balcony is a porch with a grill area and a storage room for pool equipment and the home?s seven-step water filtration system. The home is legally able to pull its water from the lake.

At the other end of the house is the utility room with a pet shower.

Upstairs, a large media room offers rows of leather theater seating. An open game room shares a full bathroom in a Jack-and-Jill setting with one of the two bedrooms up here. The other bedroom has an en suite bedroom.

Walkout access above the octagonal room provides another balcony with lake views.

The home enjoys 155 feet of waterfront with a walkable and drivable concrete path down to this arm?s deep waters. The property sits between two marinas ? Sandy Creek and Volente ? and while a boat dock could be added, Kissinger and Cornwell opted to rent a boat from a marina instead of own one.

One of the things they will miss most about this house is the ability to entertain 200 people easily and the family room?s sliding glass door.

?We?ve thoroughly enjoyed it,? Cornwell says. ?It will be hard to sell it.?

Dr. William Gilsenan joins veterinary college as clinical instructor of large animal medicine

BLACKSBURG, Va., Aug. 23, 2012 ? Dr. William Gilsenan has joined the Virginia-Maryland Regional College of Veterinary Medicine at Virginia Tech as a clinical instructor of large animal medicine in the Department of Large Animal Clinical Sciences.

Prior to joining the college, Gilsenan was a large animal internal medicine resident at the University of Pennsylvania School of Veterinary Medicine?s New Bolton Center. Before that, he was a livestock medicine, surgery, and field service intern at the Colorado State University College of Veterinary Medicine and Biomedical Sciences. Gilsenan also worked as a veterinary assistant at private clinical practices in Pennsylvania, New Jersey, and Virginia before earning his veterinary degree.

?Dr. Gilsenan brings a passion for teaching and valuable experience in equine and food animal internal medicine to the college,? said Dr. David Hodgson, head of the Department of Large Animal Clinical Sciences. ?During his time at the New Bolton Center, Dr. Gilsenan received two outstanding teaching awards and was named the best intern or resident by student leaders. He is a welcome addition to our college and department.?

Gilsenan began his position at the college on July 16. In his new role, Gilsenan will supervise and teach veterinary students, interns, and residents on large animal medicine. He will also support the Veterinary Teaching Hospital?s clinical services.

Gilsenan earned a bachelor?s degree in biology from Washington and Lee University and a Veterinariae Medicinae Doctoris from the University of Pennsylvania School of Veterinary Medicine. He is a diplomate of the American College of Veterinary Internal Medicine.

The Virginia-Maryland Regional College of Veterinary Medicine is a two-state, three-campus professional school operated by the land-grant universities of Virginia Tech in Blacksburg and the University of Maryland at College Park. Its flagship facilities, based at Virginia Tech, include the Veterinary Teaching Hospital, which treats more than 40,000 animals annually.
